Terms and Conditions

1. Introduction

These Terms and Conditions outline the agreement between us (the Trainer) and you (the Client) for the provision of our fitness training services, both in-person and online. By signing up for our services, you accept and agree to these terms and conditions.

2. Services Provided

We offer personalized fitness training services, including but not limited to:

  • Individual training sessions
  • Nutrition guidance
  • Fitness and health consultation
  • Fitness equipment or apparel sales

The specific services, frequency, and duration of each service will be outlined in the fitness package you select.

3. Payment and Fee Terms

Full payment for the chosen fitness package (monthly, 90-day, 180-day, 270-day, or 360-day plans) is due prior to the agreed start date of the training. We reserve the right to impose a late fee of $25 or 5% of the outstanding balance for late payments, whichever is higher.

4. Session Cancellation Policy

You may cancel an in-person session involving direct interaction with the Trainer, provided you give a minimum of 24-hour notice. Failure to do so results in a late cancellation fee equal to 50% of the cost of one session from your package, billed in the following month’s payment. Please note, online sessions integral to your program’s progress (i.e., bi-weekly check-ins, monthly check-ins) can be canceled, but only if you provide a minimum of 24-hour notice, subject to the same late cancellation fee.

5. Shift to Online Services

Eternal Zones LLC employs a service delivery model that begins with initial in-person training sessions and then transitions primarily to an online format. By signing up for our services, you acknowledge and agree to this transition. This shift is a standard procedure in our model and does not warrant a refund or contract termination.

If you face exceptional technical constraints that prevent you from effectively participating in online training, you may request technical assistance. This assistance may include, but is not limited to, setting up the camera for online sessions and troubleshooting software issues. Please note that the provision of technical assistance may count as a scheduled session due to the time commitment involved.

We will promptly communicate any significant changes to you. For clients not residing in the same city/state as the service location, be aware that services will be fully online from the outset.

6. Refund Policy

Our refund policy is detailed separately. Please review it to understand how and when refunds are issued.

7. Limitations of Liability

You agree to participate in our fitness services at your own risk. You must provide accurate health information and consult with a healthcare professional before starting any new fitness program. We are not responsible for any injury or health issues that may occur as a result of your participation in our services.

8. Intellectual Property

All training material provided is proprietary and remains the intellectual property of the Trainer. It may not be shared or reproduced without the Trainer’s express written permission.

9. Governing Law and Jurisdiction

These terms and conditions are governed by and construed in accordance with the laws of California, Kern County. Any dispute arising out of these terms and conditions will be subject to the exclusive jurisdiction of the courts of California, Kern County.

10. Changes to Terms

We reserve the right to modify these terms and conditions at any time. We will make reasonable efforts to notify you of significant changes, but it remains your responsibility to check these terms and conditions regularly.
